Basics Of Patent Law In India

History


In 1957, Govt. of India appointed Justice N. Rajagopala Ayyangar examine and review the Patent law in India who submitted his report September 1959 recommending the retention of Patent System despite shortcomings. The Patent Bill, 1965 based mainly on his recommendations incorporating a few changes, in particular relating to Patents for food, drug, medicines, was introduced in the lower house of Parliament on 21st September, 1965. The bill was passed by the Parliament and the Patents Act 1970 came into force on 20th April 1972 along with Patent Rules 1972. This law was suited changed political situation and economic needs for providing impetus technological development by promoting inventive activities in the country.

The In’s and Out’s of Gaining a Patent

Please note that there is more to gaining a patent than just filing an application and waiting. It is possible that this is all you will have to do, but unlikely. Once a patent application is sent in to the Patent and Trademark Office (PTO), it will be assigned to a patent examiner. The examiner will determine whether your invention really is patentable based on the criteria set up by the PTO.


If the examiner does not believe your invention is patentable based on these criteria, he or she will reject it and send you an Office Action. This action explains to you that your invention was rejected and it describes exactly why.

Is Your Domain Name A Trademark Infringement?

I recently received an email from a concerned, fellow Internet business owner, asking for my opinion on an issue that could literally destroy his Internet business and the business of several other domains involved.


He had received legal notice from a prominent company, stating that he needed to relinquish his use and rights to his web site domain name because it contained three letters that infringed upon their trademark and their domain name. This same company also contacted several other Internet business owners and made similar demands.
